Terms of Service

The agreement between you and us. It is written to be read, because terms nobody can read are terms nobody agreed to.

1. Who you are contracting with

These terms are between you and AxonVPN ("we", "us"), the operator of https://axonvpn.com and the AxonVPN applications. Company registration details are added here on incorporation, before card payments open.

By creating an account, installing an application, or using the service, you accept these terms. If you are using it on behalf of an organisation, you confirm you may bind that organisation.

2. What the service is

AxonVPN is a subscription virtual private network. It encrypts traffic between your device and a server we operate, and forwards it to the internet from that server's address. This hides your traffic from the network you are connected to and replaces your visible IP address with the server's.

It is not anonymity, and we will not pretend otherwise. It does not hide you from a website you sign in to, it does not prevent browser fingerprinting, and it is not proof against an adversary who can observe both ends of a connection.

3. Eligibility

You must be at least 18 years old, or the age of majority where you live if that is higher, and legally able to enter this agreement. You must not be a person or entity that applicable sanctions law prohibits us from dealing with. See section 11.

4. Your account

An account is a cryptographic key your device generates and a 16-digit code shown once at setup. We hold no email address, name or phone number for it. That has a consequence you should understand before you rely on it: if you lose the code and the device, we cannot recover the account or the subscription on it, because we cannot tell which account was yours.

Keep your account code and your device secure. You are responsible for what is done with them, and anyone holding them has your subscription.

5. Plans, prices and renewal

Prices are shown on our pricing page in US dollars, exclusive of any tax that applies where you are, which is calculated and displayed before you pay.

Paid plans are automatically renewing subscriptions. When you subscribe you authorise us and our payment processor to charge your payment method the plan price on the day you subscribe and on the same day of each subsequent billing period, until you cancel. Renewal is at the same price and interval unless we have told you otherwise in advance.

You may cancel at any time, in the application or by writing to support@axonvpn.com. Cancellation stops the next renewal; your plan continues until the end of the period you have already paid for. Refunds are governed by our refunds and cancellation policy, which forms part of these terms.

If a payment fails we may retry it, and if it keeps failing we may suspend the paid plan. We will tell you before that happens. A suspended account returns to the free tier rather than being erased.

We may change prices. We will give you at least 30 days' notice by email or in the application, the new price only applies from your next renewal after that notice, and you may cancel before it takes effect.

6. The free tier

The free tier is provided as it is, with the limits published on the pricing page, and may be changed or withdrawn with reasonable notice. Free accounts are subject to the same acceptable use rules as paid ones and, because they cost an attacker nothing, may be subject to additional anti-abuse measures.

7. How you may use it

You must use the service lawfully and in accordance with our acceptable use policy, which forms part of these terms. In particular you must not use it to attack, intrude on, defraud or harass anyone, to distribute malware or child sexual abuse material, or to send unsolicited bulk messages.

You are responsible for knowing whether using a VPN is lawful where you are. In a small number of countries it is restricted or prohibited, and that is your risk, not ours.

You must not resell the service, share an account beyond your plan's device limit, attempt to circumvent limits or authentication, or probe our infrastructure other than under a security disclosure we have agreed to.

8. What we do and do not promise

We work hard to keep the service available, but we do not guarantee uninterrupted service and we do not guarantee it will get through any particular network. Networks change, filtering changes, and the entire premise of the product is that this is an ongoing contest rather than a solved problem. We provide the service as is and, to the extent the law allows, without warranties of any kind.

We do not monitor your traffic, and we do not screen what you do through the tunnel. That means we cannot promise you protection from anything that arrives through it.

9. Suspension and termination

We may suspend or terminate an account that breaches these terms or the acceptable use policy, that is being used to harm our infrastructure or others', or where the law requires it. Where it is possible and lawful to warn you first, we will.

If we terminate a paid account for reasons that are not your breach, we refund the unused portion of the period. If we terminate for breach, we do not.

You may stop using the service and delete your account at any time.

10. Liability

Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you arising out of the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim, and we are not liable for indirect or consequential loss, lost profits, or lost data.

Consumer protection law where you live may give you rights that these terms cannot reduce. Where it does, it wins.

11. Sanctions and export control

You may not use the service if you are subject to sanctions that prohibit us from providing it, or if you are acting on behalf of someone who is. We comply with the sanctions and export control law that applies to us, including general licences that specifically permit the export of personal communications services and circumvention tools to populations under restrictive regimes.

12. Changes to these terms

We may update these terms. For material changes we will give at least 30 days' notice by email or in the application before they take effect, and continuing to use the service after that is acceptance. The date at the top of this page always reflects the last substantive change.

13. Governing law and disputes

These terms are governed by the law of the jurisdiction in which AxonVPN is established, and disputes are subject to the courts of that jurisdiction, without affecting any right you have to bring proceedings where you live if consumer law gives you that right. Before either of us goes to court, we ask that you write to legal@axonvpn.com so we can try to resolve it directly.

14. Miscellaneous

If a provision is unenforceable, the rest stands. Failing to enforce something is not waiving it. You may not assign this agreement; we may, on notice, to a successor of the business. These terms, with the acceptable use, refunds and privacy policies, are the whole agreement between us about the service.
